Exhibits in Alternate Care Hearings

The Iowa Division of Workers' Compensation (DWC) requires parties to electronicaly file (eFile) intended exhibits on the Workers' Compensation Electronic System (WCES).

The information on this page relates to intended exhibits in alternate care hearings.

Page Limit

Each party may submit up to ten (10) pages of exhibits.

eFile on WCES

All exhibits must be eFiled on WCES before the scheduled alternate care hearing.

Exchange With All Other Parties

Parties must exchange all exhibits with all opposing parties before the scheduled alternate care hearing.

Objections & Motions

Any objections or motion relating to intended exhibits in an alternate care hearing will be considered by the presiding deputy commissioner at the hearing.

Labels

Parties should label their exhibits as follows.

Claimant

The claimant's exhibits are labeled numerically. Example:  1, 2, 3, 4, 5, 6.

Defendant(s)

Defense exhibits are labeled alphabetically. Example:  A, B, C, D, E, F.

Joint

Joint exhibits, if any, are labeled numerically. Example:  JE 1, JE 2, JE 3, JE 4, JE 5, JE 6.

Page Numbering

Each page of every exhibit shall be numbered with the appropriate exhibit letter (claimant and joint) or letter (defendant(s)) and the page number.

Claimant

Example of page numbering for the claimant's exhibits:  1-1, 1-2, 2-3, 2-4, 2-5, 3-6, 3-7, 3-8, 3-9, 4-10.

Defendant(s)

Example of page numbering for the defense exhibits:  A-1, B-2, B-3, B-4, B-5, B-6, C-7, C-8, D-9, E-10.

Joint

Example of page numbering for joint exhibits:  JE 1-1, JE 2-2, JE 2-3, JE 2-4, JE 3-5, JE 3-6, JE 4-7, JE 4-8, JE 4-9, JE 5-10.

Non-Documentary Evidence

A party may submit evidence that is not a document, such as video or audio.

Any such evidence must be eFiled on WCES and labeled as an exhibit numerically or alphabetically.
